Was that in the Commerce Clause?

Judge Orders addict with seven children to stop having kids, unsurprisingly the NY ACLU claims that the right to procreate is “fundamental”. Sure I can see the slippery slope argument, but the order isn’t forced sterilization, it’s don’t get knocked up. There are many easy ways to accomplish that goal, so I’m all for it. 3…2…1…que being called a Nazi by the ASUO.

    There’s also this approach…

This judge claims that “every child born deserves a mother and a father, or at the very least a mother or a father.” That’s more the issue in this particular case than the mother’s right to procreate. Can you abuse a right, by the way?

So far, Melissa, a right to have a good shot at life has not been espoused by the Supreme Court.

    I’m just sayin’.

  4. Melissa says:

Eh, I can see the judge’s point. Where do you draw the line bewteen the right to procreate and the children’s rights to have a good shot at life?

    Tim:

It’s in the penumbras, along with the right to vote, travel, and some other thingies. I’d go with the ACLU on this. Granted, it’s not expedient, but then our fundamental rights tend to defy expediency, as certain members of a certain student committee are finding out.

Wait for it……it’ll be any minute now.
